Terms and Conditions
These Terms and Conditions (“Terms”) are a binding agreement between you and Boots on the Ground Services LLC (“BOTG,” “we,” “our,” or “us”) governing your access to and use of the Boots on the Ground mobile application and related services (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Eligibility and accounts: You must be able to form a binding contract in your jurisdiction and provide accurate registration information. You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly at the contact email if you suspect unauthorized access.
Nature of the Service: The Service is a technology platform that connects users who request property inspections with independent field agents and supports related workflows (including payments and communications). BOTG is not a licensed home inspection firm, real estate broker, or insurer. Inspections and reports are supplied by independent users; you are solely responsible for evaluating any results for your own decisions. We do not guarantee availability of any particular agent, job, timing, or outcome.
Fees and marketplace economics (summary): Job requests must be posted at a minimum of US$15.00. At checkout, clients pay the posted job amount plus a client service fee of fifteen percent (15%) of the job amount with a minimum of US$2.00, plus an estimated Stripe processing fee (currently 2.9% of the total plus US$0.30 per transaction, passed through to the client and not retained by BOTG). When a job is approved and payouts are released, BOTG retains a field-agent platform fee of ten percent (10%) of the job amount with a minimum of US$2.00 from the job amount; the remainder is the field agent’s job-related earnings, subject to successful payment and payout processing. In-app checkout disclosures control for any specific transaction. Full client payment terms are in the Client Terms of Service.
Optional approval tips: If the Service offers an optional gratuity at approval and you choose to pay it, you authorize us to charge the tip amount you select plus an estimated Stripe payment processing fee (currently 2.9% of the tip plus US$0.30 per transaction, passed through to you and not retained by BOTG). BOTG does not retain a platform fee on optional tips; the field agent receives the full tip amount you select, subject to successful payment and payout processing. Tip features, labels, and rounding may be shown in the app; in case of any inconsistency between this summary and in-app disclosures at the time of payment, the in-app checkout disclosures control for that transaction.
Payments generally: Charges are processed by Stripe. You agree to pay all amounts you authorize at checkout and to comply with Stripe’s terms and any additional terms presented when you add a payment method. We do not store full card numbers on our own servers. ACH, cards, and other methods may be subject to verification, delays, or failure messages from Stripe or your bank.
Stripe fees: Stripe may charge separate processing, Connect, currency conversion, dispute, or payout fees according to Stripe’s pricing and terms. For charges processed on BOTG’s Stripe account as merchant of record, card and bank processing costs are generally borne by BOTG from amounts collected from investors (and are not deducted from the field agent’s coded job or tip share amounts in our payout logic). Payouts from a field agent’s Stripe Connect balance to the field agent’s bank may incur fees or timing rules applied by Stripe or the bank to the connected account—review Stripe’s documentation and your payout settings.
Field agent Connect and payout timing: To receive job and tip payouts through the Service, field agents must complete Stripe Connect onboarding and maintain a valid connected account in good standing. We may block or delay transfers if Connect is incomplete, restricted, or if required verification fails. After client approval, BOTG automatically transfers net field-agent earnings to the agent’s Stripe Connect balance when the client’s payment has settled through Stripe—not necessarily on the same day as approval. Card payments typically settle within two (2) to seven (7) business days (longer for new platform accounts or ACH). Connect transfer usually completes within minutes after settlement; withdrawing to a bank is a separate step in the app. “Available for payout” and similar balances shown in the app are estimates based on inspection records and ledger entries and may differ from Stripe’s real-time available balance; the Service enforces withdrawal limits against Stripe when you request a payout. Refunds and chargebacks: Refunds, cancellations, and investor remedies (including any late-completion or cancellation flows offered in the app) are governed by the rules and disclosures presented in the Service at the time of the event. Nothing in these Terms guarantees a refund where the Service or law does not require one. Chargebacks may result in reversal of funds, closure of jobs, or suspension of accounts as permitted by law and Stripe’s policies.
Field agent cancellations: If you cancel a job that is assigned to you or in progress, you may be required to select a cancellation reason, which may be visible to the requester on that inspection. Short-notice cancellations may count toward limits shown in the app (such as quarterly counts) and may temporarily restrict your ability to accept new open jobs until any stated restriction expires.
Field agent profiles and availability: Field agents set a service area and travel radius in the app. You may turn off “Available for new jobs” in Profile to pause appearing in client search and accepting new open jobs while you finish existing assignments. Public profile text shown to clients (such as bio, expertise, and company name) must not include direct phone numbers or email addresses; we may restrict access until corrected.
Field agent identity verification: Field agents must complete government-issued photo ID verification (including a live selfie match) through Stripe Identity before accepting open jobs or appearing in the client directory. Clients may see an “Identity verified” badge on field agent profiles when verification succeeds. That badge indicates verification status at the time shown; it is not a guarantee of work quality, licensing, criminal background clearance, or future conduct. Acceptable use: You will not misuse the Service, including by attempting to access non-public areas, interfering with other users, scraping or overloading our systems, circumventing fees, or using the Service for unlawful, harassing, or fraudulent purposes.
Content: You retain your rights in content you submit. You grant BOTG a worldwide, non-exclusive license to host, reproduce, display, and process your content as needed to operate, promote, and improve the Service, and to enforce these Terms.
Disclaimers: THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Limitation of liability: TO THE FULLEST EXTENT PERMITTED BY LAW, BOTG AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO THE SERVICE. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID BOTG IN FEES FOR THE SERVICE (EXCLUDING AMOUNTS PASSED THROUGH TO FIELD AGENTS OR STRIPE) IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US$100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
Indemnity: To the fullest extent permitted by law, you will indemnify, defend, and hold harmless BOTG and its affiliates from any claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your content, your use of the Service, or your violation of these Terms or applicable law.
Suspension and termination: We may suspend or terminate access to the Service if we reasonably believe you have violated these Terms, pose a risk to the Service or other users, or must do so to comply with law or payment-network rules. You may stop using the Service at any time. Provisions that by their nature should survive (including payment obligations accrued before termination, disclaimers, limitations, indemnity, and governing law) survive termination.
Governing law and venue: These Terms are governed by the laws of the State of Idaho, without regard to conflict-of-law principles that would require application of another jurisdiction’s laws. You and BOTG consent to the exclusive jurisdiction and venue of the state and federal courts located in Ada County, Idaho, for any disputes arising out of or relating to these Terms or the Service, subject to applicable law requiring a different forum for consumers.
Miscellaneous: These Terms constitute the entire agreement between you and BOTG regarding the Service and supersede any prior understandings on the same subject. If any provision is held invalid, the remainder remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
